Out of contract work lien rights

My contractor stopped work on our home about 3-months ago. We mutually agreed to stop prior to the completion of the entire job as we had gotten into several disagreements. There was substantial work left to be done but mostly in the garage and the patio, but not in the house.

After he stopped work he presented a bill for work that we added and had done outside the original contract as well as a bill for some work in the garage. Price had not been previously discussed for this extra work and he consistently said it would be a fair price so we assumed that it would be.

We made an offer to settle nearly two months ago that has not been replied to and the contractor would not meet with me at a time when I was available. I would like to know if he has lost his lien rights?

Can you describe what is written into the contract and what is verbal? Hard to tell what is going on. Usually, mediation comes before arbitration. What does your contract say? Were his subs (if any) paid by the contractor and do you have releases from the subs?
