I have a good full time job. My spouse is not a citizen, and is here on the K1 visa. We have a 3-month old infant.
Recently it has come to my attention that she does not want to continue our marriage, and wants to leave the country with the infant in any way she can. I said no. She literally doesn't have anything here: No job, no income, no place to stay (by herself) no vehicle, no driving skills, no decent language skills, not even documents, either for herself or the child, etc. The reason she doesn't have any of these things is because she admitted she never planned to stay here from the beginning. In other words, I was lied to. My question is, what are my chances of getting full or primary custody with her receiving visitation rights? Or will she likely receive primary custody and a part of my paycheck, and give me liberal visitation rights? I understand that they decide based on what's in the best interest of the infant. I fear she may play the abuse card, and go to a shelter so she will later claim abuse in court. She is absolutely desperate and will stop at nothing to keep the baby, if she cannot kidnap it as she originally planned. I was against the idea of divorce, but seeing as she wanted to secretly leave the country, got me very worried and I saw that I had limited choices in the matter. Thanks, John. |
