Default Fence leaning over my property line

My neighbor's chain link fence is leaning into my property, restricting placement of my new wood fence inside my property line.

What recourse do I have -- besides suing him -- if he chooses not to repair it as promised?

Get his permission to fix it on your dime, and get his authorization to do so in writing.

The most obvious option is to file a lawsuit. If you can avoid filing a lawsuit you should, but that's my opinion.

Agreed. As things turned out, I didn't have to sue as my neighbor did the honorable thing and fixed the problem to my satisfaction.
